Terms of Use for Tonntag
1. Provider and scope
These terms apply to the use of the Tonntag app and of the address search, date preview and waitlist on tonntag.de. The provider is Real Movement Analytics GmbH, Kleines Everstal 18d, 44388 Dortmund, Germany (legal notice). The terms of the store you get the app from also apply to the download: in the App Store, Apple's Standard License Agreement (EULA), on Google Play, the Google Play Terms of Service.
2. What Tonntag offers
Tonntag shows you the waste collection dates for your address and reminds you of them. You can download and use the app for free, without an account and without ads. There are no in-app purchases.
We take the dates from publicly available information of waste providers and municipalities and check them automatically for plausibility. We give no guarantee that this information is complete, correct and up to date; our statutory obligations remain unaffected. Short-notice changes, for example due to public holidays, strikes or weather, sometimes reach us late or not at all. The information from your waste provider is binding. The app tells you if dates could not be updated for some time or if holiday shifts are likely missing.
The app schedules reminders on your device. Whether and when they appear also depends on the operating system and your settings, for example notifications, focus or battery saving modes.
3. Your data on the device
The app stores your address list, dates, reminders and settings on your device. What we store on our server for some waste providers is described in the privacy policy. We do not offer our own cloud backup. If you uninstall the app or clear its data, this data is lost unless it is included in an operating system backup. You can set up your addresses again at any time.
4. Fair use
Use Tonntag for your own addresses and in the way the app and website intend. You may not query our interface automatically in bulk, systematically extract dates or circumvent request limits and other protective measures. We limit such access technically.
5. Use of content
The app and website, including graphics, texts, sounds and software, are protected by copyright. You may use Tonntag privately within its features. Beyond that you need our prior consent, for example to copy, modify, redistribute or commercially exploit content. Uses permitted by law and rights granted under the licences of included software, fonts and other third-party components remain unaffected. The app lists the open-source packages used under “Open source licences”.
6. Development and availability
We keep developing Tonntag and improve it with updates. The dates depend on the waste providers' online services. If a provider changes or discontinues its service, dates for individual places may be missing temporarily or permanently. You can see which places Tonntag covers during setup. We do not guarantee uninterrupted operation. Dates already loaded and scheduled reminders stay on your device and also work without internet.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
8. Your statutory rights
Your statutory rights remain unaffected. Rules on digital products apply where their legal requirements are met. If you have questions or problems, you can reach us at [email protected].
9. Changes and final provisions
Changes to these terms for existing contracts require your agreement unless the law permits a change without it. Publishing new terms alone does not change your existing contract. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. This is a translation of the German version, which prevails in case of discrepancies.
