Terms of Use for pumlet
1. Provider and scope
These terms apply to the use of the pumlet app. The provider is Real Movement Analytics GmbH, Kleines Everstal 18d, 44388 Dortmund, Germany (legal notice). The terms of the store you get the app from also apply to the download and to purchases: in the App Store, Apple's Standard License Agreement (EULA), on Google Play, the Google Play Terms of Service.
2. The app
pumlet helps you spend less time in distracting apps. You choose these apps and a daily budget, start focus sessions during which the apps are locked, and your companion grows along with you. You can download and use pumlet for free, without an account and without ads. You can optionally buy pumlet Pro (section 3).
Measuring and locking rely on the Screen Time features of iOS or the usage data of Android and need your permission. What they can do depends on the operating system. If you revoke a permission, battery settings restrict the background service or the operating system changes these interfaces, locking may fail or measure inaccurately. pumlet is a self-control aid. It is not a parental control and does not replace medical or therapeutic treatment.
3. pumlet Pro
pumlet Pro unlocks additional features described in the app and in the store listing. Pro is available as a monthly subscription, a yearly subscription and a one-time purchase (“Lifetime”). Purchases go through the App Store or Google Play: before you confirm, the store shows you the applicable price and term, takes the payment and sends you the receipt. This website does not accept payments.
Renewal and cancellation: Subscriptions renew automatically for the chosen term until you cancel. You cancel in the subscription settings of your store account: on iPhone under Settings › your name › Subscriptions, on Google Play under Profile › Payments & subscriptions › Subscriptions. Cancellation takes effect at the end of the paid-up period; you are entitled to Pro until then. In the App Store you must cancel at least 24 hours before the end of the period, otherwise the subscription renews once more. On Google Play you can cancel until the renewal. Deleting the app does not cancel a subscription. If the price of an ongoing subscription changes, the store informs you in advance and asks for your consent where required.
The one-time “Lifetime” purchase has no term and does not renew. The app stores your Pro status on your device. On a new device or after reinstalling, you get it back with “Restore purchases”, signed in with the same Apple or Google account. If a paid purchase does not arrive, the app checks for open purchases at the next start; if that does not help, email us at [email protected].
4. Your data
Your companions, stats and settings are stored only on your device. We do not offer our own cloud backup. If you uninstall the app or clear its data, they are lost unless they are included in an operating system backup. The export in the app creates a copy for you; the app cannot currently import this file. Purchased Pro rights stay with your store account and can be restored.
5. Use of content
The app and website, including graphics, characters, texts, music, sounds and software, are protected by copyright. You may use pumlet privately within the app's features, including sharing images and results. Beyond that you need our prior consent, for example to copy, modify, redistribute or commercially exploit content. Uses permitted by law and rights under the respective licences of software, fonts and other third-party components used remain unaffected.
6. Development and changes
We keep developing pumlet and improve it with updates. Updates required by law remain guaranteed. Further changes to paid services provided on a permanent basis are only made for a valid reason (e.g. security, a change in the law, technical development), at no extra cost and with clear information. If a change affects access or usability more than insignificantly, we inform you in good time beforehand on a durable medium about the nature and timing of the change and your statutory right to terminate the contract free of charge within 30 days. The period begins when you receive the information or, if the change takes effect later, when it takes effect. Statutory exceptions remain unaffected.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
8. Your statutory rights
You request voluntary store refunds from the respective store. You can assert statutory claims against us, in particular for defects, price reduction or termination of the contract, directly with us. They do not depend on a refund decision by the store. A statutory right of withdrawal also exists independently of store refunds. For digital content it only expires early under the statutory conditions, which the store's purchase dialog informs you about.
9. Changes and final provisions
For existing contracts we only change these terms with your consent, unless the law allows a change without consent. Publishing new terms alone does not change your existing contract. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. This is a translation of the German version, which prevails in case of discrepancies.
